I should mention that I personally don't have knowledge of the batteries. I'm just going by what someone else who received these told me.

The package doesn't say anything at all about the battery being included nor the actual type of battery, but there is a warning (see at the bottom of this note). On the back of the package it says: *Pets love to chase the laser beam *Great way to keep your pets active and fit*Convenient keychain design *Also great for: Presentations, SemiCoaching and *Use the laser to make your point! There are some warnings such as "Do not aim this or any laser in the eyes of people or animals. There's a Safety Warning: Choking hazard. Contains small parts. Not suitable for children. And a Battery Warning: Do not mix old and new batteries *Do not mix alkaline, standard (carbon-zinc) or rechargeable (tri-cad, tri-mh?) batteries. (Sorry, the words are super tiny and hard to read.)
