Once you register it to your own Amazon account, any books that he has on the kindle will be removed. You would have to purchase your own books. The books belong to the Amazon account not the device.

Yes the battery still holds a charge and I used it for about a year and a half when I was staying in motels for work that has free wifi and I could uset internet, also there are a bunch of books downloaded in it and during the brief times that I got to come home a friend of mine borrowed it for about two weeks and put some things on it, I no longer have wifi and I live in a rural area so It still has content in it.

I need to mention also that some of the letters on the keyboard are wearing off so a white permanent magic marker would come in handy to touch them up
