Brand new and never used, however had a mishap when taking off the cap for pics it nicked the side of the lipstick but barely, you can see in picture 2 and 3 it's not bad at all!

Also wanted to mention when I took off the cap the first thing aside from the color I noticed was the absolutely delicious smell, I've never smelled such a lovely lipstick before!
