No. My son routinely gets these items as he is a collector. He removes them from the packaging, partly to inspect and partly because it is easier to ship without packaging if he resells. This one did not meet he it standards for a collection item. It is a nice little plastic figure. No visible damage, but it is Hasbro so it is a child's quality toy.

No. In reality, my son kept the shield. This is just the little Captain America figure.
