Yes, when I got it, I saw where the tiny dial (I forget the name for it) was pulled out. I pushed it in to make sure it worked. I ran it for about 15 mins. and pulled it out again so not to waste it. I bought it with the understanding it had a brand new battery. I would say it's new.
