Considering the reverse picture shows the coin is stamped "copy", I would take that as part of listing description. More people should look over a listing in detail before they bid.... it stops dumb questions and whining after the fact!

Just because it says Kellogg & Co does not make it a copy. Kellogg & Co. was a private mining company in San Francisco that produced these coins in 1854 and 1855, with their name in the band instead of liberty. This is a repro of an authentic territorial piece.
