When they upgraded they forgot to uncheck the Find my phone feature on the phone. By the time they got around to selling it, they had deleted their gmail account and forgot the password. So, it is Activation Locked. Without the Gmail account or password , the phone can not be activated.

Only the gmail account associated with the phone can be used. I tried my iTunes account and it didn't work, So No.

Got it from a Relative, they Deleted their Gmail account and no longer remember the password.

The relative tried that, without the Gmail account being active and not knowing the password , Apple wouldn't unlock it.
