it is a contract phone thru AT & T but there is no contract it needs to b activated or it can b used with an already active ATT account

This does not require a data plan

It does not need a data plan but has the capabilities of a smart phone (that was why we chose this Phone) I do not know if it can be used as a prepaid phone you would have to contact ATT.

My Dad worked for AT&T for 45 years, If this is a contract phone that was never activated it can be used a s a pre-pay phone. As long as the "Original account" that this was oredered from is clear of any charges. Hope that helps.
