R4 cards are legal until you download non-homebrew NDS roms that you do not own. So it's up to the owner.

I was just looking here, but are sure these are legal to sell? These things have been known to cause a lot of damage to systems. Believe it or not, there were "hack-packs" made for the original DS using cards like this for online games like Metroid: PH and CoD. The people that made these cards were thrown in jail for pilfering and something else. That's why I'm asking ._.
